1. ACCEPTANCE OF TERMS
By accessing or using the services provided by Job Boardly, a platform operated by Gobias Industries, LLC ("We", "Us", or "Our"), you agree to comply with and be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Services.
2. DESCRIPTION OF SERVICE
Job Boardly is a platform that allows users to create their own job boards, enabling connections between job seekers and potential employers. While Job Boardly provides the tools and framework for creating job boards, it does not operate as a job board itself.
To use certain features of Job Boardly, you may be required to register. You agree to provide true, accurate, and complete information during the registration process and to update this information to keep it accurate. We reserve the right to suspend or terminate your account if any information provided proves to be inaccurate, not current, or incomplete.
4. USER RESPONSIBILITIES
You are responsible for all activities that occur under your account. You agree not to engage in unacceptable use of Job Boardly, which includes, without limitation, use of the Service to:
- Disseminate or transmit unsolicited messages, chain letters, or unsolicited commercial email;
- Disseminate or transmit material that, to a reasonable person, may be abusive, obscene, pornographic, defamatory, harassing, grossly offensive, vulgar, threatening, or malicious;
- Violate the rights of any third-party.
We may, in our sole discretion, terminate or suspend your access to all or part of the Service for any reason, including breach of these Terms.
Job Boardly is provided on an "as is" basis without any warranties of any kind, whether express or implied. We do not guarantee that users will successfully establish job boards, that employers will offer jobs on these boards, or that employers will view any profiles or resumes on boards created using Job Boardly. Job Boardly merely provides the tools for users to create job boards and does not take responsibility for the content, operations, or outcomes of these boards.
8. LIMITATION OF LIABILITY
To the fullest extent permitted by law, Gobias Industries, LLC shall not be liable for any direct, indirect, punitive, incidental, special, or consequential damages arising out of or in any way connected with the use of Job Boardly.
9. GOVERNING LAW
These Terms shall be governed by the laws of the state of Tennessee in the United States of America, without regard to its conflict of law provisions.
10. CHANGES TO THESE TERMS
We reserve the right to modify these Terms at any time. Changes will be posted on this page with the date of the latest revision. Your continued use of Job Boardly after changes are made signifies your agreement to such changes.

12. THIRD-PARTY AUTO-IMPORTER FEATURE
Job Boardly provides a mechanism that allows users to auto-import job listings from third-party applicant tracking websites using our auto-importer feature ("Auto-importer"). By using the Auto-importer, you acknowledge and agree to the following:
- User Liability: While Job Boardly provides the mechanism for the Auto-importer, you are solely responsible and liable for any and all data you choose to import using this feature. You must ensure that you have the necessary permissions and rights to import data from third-party websites. You are responsible for ensuring that your use of the Auto-importer complies with all applicable laws, regulations, and terms of service of the third-party websites.
- No Endorsement: The provision of the Auto-importer does not imply an endorsement or affiliation with any third-party applicant tracking websites. Job Boardly is not responsible for the content, accuracy, or practices of these third-party sites.
- Indemnification: You agree to indemnify, defend, and hold harmless Gobias Industries, LLC and its affiliates, officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from your use of the Auto-importer, including but not limited to any violations of third-party rights or any applicable laws, regulations, or terms.
13. TRIAL PERIOD AND SUBSCRIPTION
- Trial Period: Job Boardly offers a 7-day trial period for new users ("Trial Period"). To initiate the Trial Period, users are required to provide valid credit card information.
- Automatic Subscription: Unless cancelled by the user before the end of the Trial Period, once the Trial Period concludes, the user will be automatically enrolled in a subscription, and the provided credit card will be charged based on the subscription rate communicated at the time of trial initiation.
- Cancellation: Users can cancel their trial or subscription at any time through their account settings or by contacting Job Boardly's customer support. If cancelled before the end of the Trial Period, the user's credit card will not be charged. If cancelled after the commencement of the subscription, charges for the current billing cycle will not be refunded, but no future charges will be made.
- Notifications: It is the responsibility of the user to be aware of the end date of the Trial Period. Job Boardly may, but is not obligated to, send reminders or notifications regarding the impending end of the Trial Period or the commencement of the subscription.
- Changes to Terms: Job Boardly reserves the right to modify the terms of the Trial Period or subscription at any time. Any changes will be communicated to existing users in advance.
14. USER-GENERATED CONTENT
- Responsibility for Content: Users of Job Boardly can create their own website pages and post content on their job boards. Users are solely responsible for the content, accuracy, and legality of any information or material they post or display on their job boards. Job Boardly does not monitor, verify, endorse, or guarantee the content posted by users.
- Prohibited Content: Users agree not to post content that:
- Is defamatory, obscene, pornographic, vulgar, or offensive;
- Promotes discrimination, bigotry, racism, hatred, harassment, or harm against any individual or group;
- Is violent or threatening or promotes violence or actions that are threatening to any person or entity;
- Violates, or encourages any conduct that would violate, any applicable law or regulation or would give rise to civil liability.
- Removal and Termination: Job Boardly reserves the right to remove any content for any reason, including content that we believe violates these Terms or our policies. Users who post prohibited content may have their access to Job Boardly terminated.
- Indemnification: Users agree to indemnify, defend, and hold harmless Gobias Industries, LLC and its affiliates, officers, directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees) arising from their posted content or violation of any terms of this section.
